Law in Practice

10 Years of the Anti-Corruption Law:

Progress in corporate integrity programs

2023 marked ten years since the Brazilian Anti-Corruption Law (LAC) was enacted, a milestone that opened the way for significant development within Brazil’s corporate integrity culture. The law has strengthened companies’ focus on ethics, preventing illicit activity and boosting collaboration with government authorities via leniency agreements. During this period, the LAC has gained particular prominence for holding companies involved in corruption and irregular actions against Brazil’s public administration accountable, while also promoting increasingly sophisticated compliance systems.

“Nowadays in Brazil there is a strong expectation that companies of certain sizes will have well-designed corporate integrity programs, and enforcement agencies have begun to push for corporate integrity programs that go beyond merely preventing corruption. There is a trend to integrate ESG criteria, such as sustainability, diversity, and proper labor relations protections into the corporate integrity framework. In addition to that, enforcement of the Anti-Corruption Law has picked up in comparison with the last couple of years. It remains highly relevant and is potentially poised to make a greater impact”
